Dealing with leave of absences issues are among the most commonly occurring, challenging, and legally regulated aspects of an employer/employee relationship. Even if an employer makes an "honest" mistake, the employer will suffer significant business and legal consequences. In Part II of our Leave of Absence seminar series, we will help untangle the issues and provide real world solutions to manage these difficult situations. We will touch on all of the laws that typically impact leaves of absence, including but not limited to the FMLA/CFRA, the ADA, and Workers’ Compensation, and how they interact with each other. By the end of this seminar you will be able to:

  • Properly administer leaves under the FMLA/CFRA, including benefits, intermittent leave, return-to-work (re)certification, and leave abuse.
  • Understand how the ADA defines “disability,” and when you have to consider providing reasonable accommodations, including leaves of absence.
  • Recognize when work comp claims may arise, including what considerations go into determining whether to provide light duty or leaves of absence.
  • Identify potential risks and corrective action measures to ensure continued compliance.
  • Our Presenter
    Jonathan M. Werner
, Senior Counsel for Jackson, DeMarco, Tidus and Peckenpaugh, focuses his practice in labor and employment law, where he represents and counsels primarily management in a variety of contexts.
